Hello Friends :
I recd. an email from my attorney this evening stating that "We have mailed you the FOIA request for your and your spouse's signature."
This doesnt make any sense to me, as to what does FOIA mean to start with. So I emailed them back asking, what does it mean and is it something to do like RFE towards my AOS papers filed on 2nd July,2007 (no checks cashed yet, no info in system yet).
My Attorney replied back stating that - "We have filed for full copies of your petitions to be sent to us. The FOIA will allow us to obtain a copy to check the integrity of the filing for our records. Looks like, it will be several years before these I-485 petitions are actually reviewed by the Service unless we see a change in the law. ."
What does this all mean? I am so confused....

Hi,
My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?

Hi,
I applied for 3 year H1B extension for different employer
Atty ,filed wrong Date of Birth in I-129 form.
How to correct this problem??
Atty said, they will inform USCIS after get the Receipt Notice.Is it corrct ??

The attorney can always send an amendment as I believe...But would be good for you to get it cleared...Followup up with the attonrney....Donot let it just slip through....These things have a tendency to take a life of their own and can create lotta headache.,...

BTW, the easiest way to get back to H4 status is by reentering the country using H4 visa. For which, you will have to maintain H1 status, if you want her to have H4 status in the future.
I think she/he can change status from EAD to H4 without reentering the country...There is something like change of status ....I am not sure about it...Experts can comments further...

Man I dont know what is the answer to ur question. But I feel very sorry for you and want to appreciate you for keeping your sanity intact till now. One of my minor dependents appears to have been out of status due to non renewal of their H4 visa. We thought that like the original application, dependents were covered by my renewal, found out too late that this is incorrect. Since then we have obtained renewals and the dependent in question now has an approved H-4 status, plus pending 485 and advanced parole.
I have been told though that time out of status is not counted against minors. Is this true?
Is there any risk in travelling out of the country to get visa stamped and returning? I understand this resets the clock. Can the embassy look into the history, find out that previous issue and deny the H-4 stamping because of it?
I am very discouraged by this long drawn out process. Any information would be appreciated.
PS: The minor in question just turned 14 years old. Could this be the reason?

I'm talking about post completion OPT - if you have ur EAD card, u can travel with a valid and current employment letter. When it's pre-completion OPT, u r on F1 anyways so u should get stamping...

The local San Diego USCIS office suggests that certain remedies may be available for military families facing the problem of ineligibility to adjust status because of unlawful entry by a family member seeking adjustment of status. Most often the situation occurs when a United States citizen service member�s spouse entered without inspection and thus cannot adjust status. I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.

Your Company has to file LCA not you. Technically they have to file H1B amendment. Many people does not this. It has to be filed Immediately. There is nothing like grace period.

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

If both of you having 1098 forms from school you can file for Hope-credit (each gets $2500 credit, thats huge amount :) ). You cannot show the Apt. on tax form.
