In other words, if I created the document in Illustrator and "printed it" to a pdf file, you would not need Illustrator to view the contents.

    Hello,

    Did you receive the compensation at all? If so, the deposit slips from your bank may be a possibility as proof of payments. If you haven't been paid at all, you might be a victim of a bad employer and you should report the employer to Department of Labor in US.

    If you are now entering US on L-2, there should not be any questions around your earlier H1-B, but the IO can always ask about your earlier stays in US and hold you up. Ask your employer to provide you a certificate on company letterhead with authorized signature stating the compensation provided to you while on H1-B, though 'I lost your paystubs' is a really flimsy excuse... ;)

    Please consult a good lawyer before making any decision...

    Hi All,

    I need some advice from gurus.

    1. My company filed for my labor and then EB2-140 with March 2007 PD.
    2. A labor became available with EB3 specs and September 2002 priority date.
    3. I wanted to capture that but my company lawyer said no stick with EB2.
    4. Just before July 07 fiasco, when labor-sub was getting eliminated, I asked and applied for labor-sub I140 with Eb3 and September 02 PD.
    5. Filed I485 with EB3 140's copy and receipt number.
    6. Just recently both of the 140s got approved.
    7. Eb3 PD is not current but if I could use the EB3 pd to put into EB2, I could be current. Is there a way or am I day dreaming?

    Hi,

    Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.

    In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
    Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

    Hi,

    I've read conflicting information on whether one is eligible to receive unemployment benefits.
    Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.

    So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

    Yes, a derivative spouse can avail unemployement benefits and not jeopardize green card. Make sure she is eligible as per state laws. Each state has a different rule on who is eligible. Do some homework by calling your local unemployement office. I know of at least couple of immigration lawyers who discussed this on their newsletters. I know sheela murthy's website had that info too. Google for it and read.....

    Hello everybody,

    My wife who is on H4 was denied admission to a masters in accounting program due to lack of work experience. Other factors (GPA/GMAT scores) were allright according to a professor at the university! Does anybody know how/where she can get some experience (voluntary/unpaid/intership). We have already looked at craigslist job listing in the non-profit sector and not many people are looking to hire even if its unpaid:eek: We reside in Raleigh/NC and was wondering if someone in this forum has some insight as to how we can move forward.

    Please understand that by law they can hire you ONLY if a position presumes volunteer work. If there are other similar positions that ARE PAID, you are out of luck.
    My wife is a chemist. That's even worse.

    Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.

    Example:

    LCA start date: 9/1/10

    LCA end date: 8/31/13

    Form I-129 start date: 10/1/10

    Form I-129 end date: 8/31/13

    Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.

    Although under certain circumstances USCIS has agreed to accept H-1B petitions for processing that include LCAs that have not been certified, attorneys should understand that if the LCA submitted with the H-1B petition is eventually denied, the H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) will be denied, even if a subsequent certified LCA is submitted. This is even true where the denial is due to DOL error in not being able to verify a petitioner's FEIN. However, USCIS has also indicated that if the sole reason for failing to apply for an Extension of Status or Change of Status is due to DOL delay in the certification process, USCIS may look at the totality of the circumstances in determining whether to accept the late filing.

    Bottom line is that getting an approved LCA before April 1, 2010 is crucial. Pay attention to detail and get the files ready in advance is a must.

    I came to the US on F1 for MS and then trasferred to another college to pursue my PhD. During this time my F1 visa expired, but I am maintaining my legal status as my I-20 is valid. I got married last year and my wife who originally came on F1, is now on H1.
    I am going to planning to go to India in end of April and need to renew my F1 visa. What are the chances of my renewal getting refused, due to my wife's H1 (dual intention) status? What documents if any, can I show in order to prove that I have intentions to come back to the US?
    I need to get a visa interview date soon, so please reply as soon as is convenient.

    Should not be a problem. just keep some property docs.
    Worst case, they will give you H4 visa. Once you enter on H4, you can file I-539 to change from H4 to F1.

    I guess we should ask them to remove the employer's restriction, which is the prime reason for extreme exploitation. H1b should not be restricitive. IV should also address the same. We are looking at the current problem with retrogression only, but what about future aspirants who come on H1.


    H1B quota and H1B related issues are not primary concern of this organization. Greencard retrogression is. It has been that way since the inception 18 months ago.

    We have taken positions to make H1B more workable and have less restrictions on it regarding H1 extensions and H1 transfers and therby opposed major portions of Durbin-Grassley.

    HOwever, right now is not the time to debate and have open discussion on flaws of H1B program.

    This is distraction at minimum and ammo for anti-groups in worst case scenario. Please contribute, send webfaxes, make phones and provide live updates and save this discussion on H1B flaws for slower times.

    Simply going by the voting standpoint, I think between now and 08 elections, politicians will have little incentive do anything about our case (i.e., legal immigration) realistically. I'm not sure whether we represent a % of voter population that's high enough for them to place our case on their priority list. Moreover, giving us GC now will probably benefit them (in terms of votes) at least after 5.5 years once the GC holders are citizens and hence able to vote.

    Just my thought for what its worth.

    Guys,
    I think we should start a new campaign be it a flowers campaign or a simple card or Fax/letter campaign. But we need to start this ASAP. We should a 'Seek information' campaign. Each of us write letters and faxes to DOS and USCIS and request them for this.

    In May'07 the DOS moved forward the visa dates by 2 years for almost all categories. What if USCIS received more than 140,000 applications enough to exhaust 2007-2008 quota in that case Visa dates will either won't move or may move 1-2 months through out the next year. And we like fools will keep watching the Visa bulletins just to be disappointed each month.

    Now since USCIS have already receipted (or will soon do it) all the June applications, they should be in a position to release the infomation on how many applications they received for each category and for each country. We will request both the agencies to work together and release some kind of statistics some predictions like what they expect for Sept visa bulletin and further. We are living in dark and information like this will give us some insight and will let us plan our careers. Until we press them for information they won't release anything.

    Guys please think about this seriously, I think this is the need of this hour.

    Dear Experts/Lawyers,

    I wanted to ask a question about my status based on the situation described below:

    1. I entered the United States on F1 Visa in 2003.
    2. Applied for and got H1B approved, with the bottom right part attached. The visa was valid till November 2008.
    3. Applied for and got H1B extension approved, with the bottom right part attached. The visa is valid till November 2011.
    4. Never left the United States since I entered in 2003 on F1 Visa.
    5. My passport expires in the middle of 2010.

    Based on this, in order to ensure my legal stay in the United States, do I need to do anything except renew my passport at some point of time before it expires, in terms of either having to leave the US, or go to some agency to update something? Please suggest. Thank you for your help.
