I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...

Your education evaluation is valid for a long period(not sure how long). I applied for my first H1 in 2000 and got education evaluation that time. Stamping didnot work out for me that time.
I applied for new H1 in 2003 and submitted same education evaluation that I got in 2000. I entered US and used same edu eval for transferring H1. I did not have any issues.
So you are fine. I dont know if this applies to all cases.

I have been working for a private company LLC that operated as 3 smaller LLCs (regionally) but had the same/very similar names (e.g. XYZ, XYZ Asia).
I had H1Bs , LC, 140, 485 with this company.
Right now-
I have an approved 797 until 2010, but stamp expired in 2006

Got EAD, AP in Aug 2007
Entered the US on AP in Dec 2007
The company and its regional entities changed the corporate structure and are now under a new legal entity name- XYZ (same as above). This happened after I got my EAD. To an outsider or our clients- there is no change. I have not signed any new employment papers with the new legal entity. Other than the address on my paystubs changing from my local headquarters to the WW headquarters nothing has changed for me.
Questions
Should I avail AC21/EAD because I am technically working for a different company?
Since this new entity has taken on the responsibilities for the old one, should I file something with the USCIS if they happen to check on the old entity when they adjudicate the 485?

As you can see for my profile my labor cert was filed in Dec 2002 and I am Eb3 India. So all these years I have been assuming my priority date for I485 processing as Dec 2002. But now it seems there is a problem.
There have been two I-140 filings for me - first the original one which has the correct priority date of Dec 2002. Later on the company was acquired and the new company filed a successor of interest I-140 in Aug 2007. This I-140 was approved in March 2008. I have copy of this 2nd I-140 and didn't pay attention to the priority date printed on this I-140. To my dismay the priority date mentioned on the Aug 2007 approved I-140 is Aug 2007.
I wanted to find out what was the priority date in USCIS records and I called the 1-800 number. They asked me to meet the local USCIS office so took the Infopass this morning. The local San Jose USCIS office says that they would take the Aug 2007 as the priority date :( and have told me to contact my attorney.
As you can imagine I am quite devastated. Has anybody been in the same situation where the priority date on I-140 was different from Labor filing date? How did you get it corrected.

I have been a GC holder for the past two years. I obtained the GC through employment but lost my job 3 months ago.
I am planning to leave Boston, spend a month in Canada and relocate in CA when I return to the USA. I will be driving out of the US to Canada during the first week of May 2010, spending a month in Canada and then coming to California early June 2010 by plane with my LPR status.
I will use the on-line change of address tool before traveling to Canada to let the USCIS know of my new permanent address in California. I already have a place to live in California.
My questions are:
1) Should I expect to go through some problems at the airport when going through the custom?
2) Will they ask me if I am employed?
3) Should I let the USCIS know of my new permanent address just 10 days before I go to California, or earlier?
Any advice?

2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.

i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

Once USICS receives your app they will send out a document for finger printing.You should take a infopass appt and go to a local USCIS office to be finger printed.
The time frame to receive this document ranges anywhere from a month to 2 or more.

not possible. Many documents in first 2 phases are companies. Its is illegal if employee is involved Labor process in any way.
Find someone who will file H1 for you next year and apply for GC....
