Hi all
My I-485 is pending(EB-3,India)since 2007. I changed employer & successfully ported PD on new I-140 approval in EB-2 category. My PD is in Oct 2006 & I expect that to become current in the coming few months.
Now, I need to do Interfiling to link my pending I-485 to my new I-140.
(1) What all documents/wordings are required for interfiling? Can someone pls provide a checklist?
(2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?
(3) Can I send my Interfiling request to USCIS even before my PD becomes current?

pending status.
Among the documents required to sponsor for B2 visa, I'm supposed to
send copies of I-797 and I-94. I have old employers H1B approval notice
and I-94, but not of the new employers. I have the H1B receipt notice
related to the new employer.
Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
interview in the US consulate with all the other essential documents
including new employers H1B receipt notice without the new employer H1B
approval notice.
Any of your valuable suggestions are welcome.

Hello All:
We got our FP done yesterday at the Atlanta ASC and thought I would share the experience and procedures incase anyone was interested or looking for this info.
Received FP notice on 3/5/08 for FP appointment on 3/19/08 11:00am at 1255 Collier Road, Atlanta, GA 30318.
We reached the ASC on time. At the door the security guard checks the FP notice and verifies your identity with either a Passport, GC or DL. We only showed our DL and it was fine. NO BAGS and NO CELLPHONES allowed. Was asked to leave my wife's bag in the car. Also, they will not allow ANYONE except the person with appointment in the office. I saw spouses who didnt have appointment waiting outside.
You then go into the office (which is basically a BIG room) with seats and fingerprint stations and the FP notice and ID was checked again and given a form to fill out. Simple form, nothing different. All the information needed on the form (A#, Receipt No.) is on your FP notice. You fill out the form, return it and get a ticket to wait in line. The receptionist also Stamped the FP Notice at this point. We saw approx 80 people all with the same appointment time.
When your number is called or shows up on the counter, they look at your documents again and took us to a FP station. FP Notice was scanned in and was asked to verify the spelling of my name and Address. Then they took FP of all 10 fingers, then again of Index Finger (both hands) and the again of both Thumbs. He saw the FP on the monitor and retook some of the FP again. After that, Picture was taken. The FP Technician then signed the FP notice on the stamp given earlier.
The entire process from before entering to exiting took about 1.5 hours. I would recommend you take a book or magazine to pass some time.
Sorry for the long post but just thought someone might be looking for this information. I am not aware if any of this information for the other centers.

Hi, I am a holder G4 visa working on a international institution in Washington DC, USA...and my fiance is a G4 visa holder too, working on other international institution in the same city (we are foreigners, south americans, especifically)...ok...the main issue is that we want to get married next month in USA and sure as G4 visa holders at that time....but on this September, my fiance is going to change his status to a F1 visa, because he is going to pursue his PHD on a US University....and I cannot change my status as dependent of him (F1 dependant), cuz I need to keep working, and I dont know if it is necessary for studying here to have exclusively F1 visa as a foreigner student, or he could become a G4 visa dependant from me, after he stop working to start studying.
...So my question is if we get married before that he changes his status from G4 to F1...would I be able to keep working on any international institution meanwhile he can keep his F1 student visa?, with no need to become a dependent from each other, but to keep, my G4 visa, and his future F1 visa, respectively?
My doubt is based on one comment that i heard from someone, but i am not sure, cuz that person told me, that if my husband changes his visa from G4, resigning my G4 dependent status, i couldn't be rehired later...i tried to get advide from a lawyer but his service is so expensive for me...so i hope someone can help me, cuz this issue is so important for us.
Ps: For more information, my fiancee would have to go to his country and getting his F1 visa and go back to USA as a F1 visa holder....And before that trip...we would like to get married...and meanwhile he is studying with his F1 visa, I can work with no problems with my G4 visa rehired as many times as I am re hired...

Here are few pending immigration bills which have a higher chances of passing in both house and senate. I was looking at some of the bills and noticed when a bill (or a varient )is introduced in both houses simultaneously the chances of that bill passing are higher.
This may be a good idea for us to try pushing some of the EB related measures if we can
into these bills. I know someone may say Hey these are family related bills But remember how they add the immigration, healthcare, veteran measures into budget or appropriation bills.....similarly we can try.

Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

I also would like to know an answer to this question. can I go to school once my 485 is pending for more than 180 days, provided I have 140 approved? If my 485 approval comes whle I am still in school, what would it mean in terms of any complications?

I want to apply for AP but I'm not sure if I qualify and I don't want to get rejected as I cannot afford to lose the money. I am here on F-1 visa and got married and subsequently have applied for I-485 and got receipt for it.
1. Can I apply for advanced parole?
2. I want to go home and visit family and/or have AP in case I need to leave. Is this a valid reason? Is this what I write as my reason on form?

For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:

And for the first time, it�s not enough to be in compliance. Each company must prove compliance, and if using an electronic system, use one that works in accordance with immigration laws.
The San Diego Union Tribune reports (http://signonsandiego.com/news/2010/oct/09/immigration-audits-are-increasing-against/), enforcement in San Diego County mirrors a national trend toward more scrutiny of employers� I-9 forms, the universal tool for verifying permission to work in the United States.
Immigration and Customs Enforcement, or ICE, initiated 66 audits with local employers in the fiscal year ending Sept. 30, reviewing 5,588 individual I-9s in the process. That was up from 44 audits in fiscal 2009 and just one audit in 2008. A company can be fined up to $1,100 for each illegal employee, and knowingly violating verification laws can lead to criminal charges and forfeited assets.
So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Please advice how to proceed to get this process done properly, legally and fast, reasonably possible and how much time it would probably take. Thanks in advance!
