Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways :confused:

Your H1B LCA denial will not have negative impacts on your GC. To keep the records clean, fill out a new I-9 form and submit to HR.

I have a question which I have been wanting to ask for a while, so if GC is for a future job then can someone incorporate a company and work for self on EAD/AC21. If there is query for ablity to pay then at that point can you have an offer from other company and work for that company for 6 months once you get 485 approved.

I am using my EAD and working for the company which filed by PERM/I-140/I-485. Currently I am being paid a lot more than the prevailing wage on the PERM so my company has suggested me that they will give the amount listed on the PERM as a salary and the remaining as a check to the company that I own. I have a business in my name but all I did was register the company name; never actively ran the business.
Please share your concerns/opinions about the possibility of above scenario. Do you think taking the salary and B2B expense would cause a problem with the green card process?

The USCIS provided further clarification and instructions on I-140 premium processing following the initial announcement. They listed three types of cases that are not eligible for premium processing, even if they are within the EB3 preference category. These are:
a second I-140 filing, if an initial I-140 remains pending
a labor certification substitution request
a duplicate labor certification requests (i.e. those cases where the original labor certification is not included)
These cases simply have additional processing requirements that cannot be met within the premium processing timeframe. These exceptions are in addition to the EB3 �other worker� cases which, as mentioned above, are not eligible for premium processing.

I don't believe leaving the company that you had signed an I-9 form with have any impact on your GC app as long as you have a same or a similar job lined up if and when you do get an RFE regarding the same.
As mentioned several times, GC is for future employment and you can switch employers as many times as you want under AC21 (of course you don't want to go overboard with switching employers every few months either :)).
I hope this helps - again this is my understanding of the law and not a legal opinion.

you have to wait till 180 days .
Your employer can revoke 140 in once that you filed i-485 within 180 days .

At the time of filing my application I just used one address.
Somehow I didn't know you could use Permanent address and current address.
I'm not sure but I guess my lawyer didn't file G325 form.
Is filing G325 form something mandatory ?
I've moved recently.

My wife recently went for a H1B renewal stamping in india. They visa officer provided a 221(g) administrative processing (pink) requesting additional documents (job description, reasearch projects, previous visas list etc..,). She is preparing the necessary docs to submit the same. Since she went to india for a short trip (travelling back next week).
1. She has Advanced parole. Can we use Advance parole??
2. If we use Advance parole, then once the Adminstrative processing is complete, how do we handle the stamping?? Do we need to go back again to the consulate to get the stamping done? or is there a way to withdraw the visa application from the consulate??
I would greatly appreciate if someone is similar situation share their experiences

My company merged with another one last year just after my I-140 was approved. I'm preparing to file I-485 (doing it myself) and I'm wondering what kind of documents/letters do I need to submit to USCIS to proof that my job wasn't affect by the merger and I'm still working in the same position.
I'd really like to send all required information to USCIS so that I don't have to reply to RFEs later on.
Any examples of letters or list of supporting documents will be appreciated.

My dear friend, because when you have filed for I-485, so did 3,49,999 others. Your category will not get more than 3500 visas a year ((1,40,000 *7/100)/3). No matter what your priority date is, USCIS will not even get to your application for atleast a year and after that, the PD may not move forward for several years. At this rate you will not get a GC for several years !!!!!

The problem is in your brain (opps) I meant perception. You may be able to change jobs on EAD, but you cannot get promoted to a job with a different job description. You cannot get a raise more than nominal raise (5%). Bottom-line, you cannot do anything where you will not be able to justify that you will perform job listed in I-140.
So, what should I do?
Lobby to change the laws. Participate in lawmaker awareness programs. Expresss support to people who are trying to get laws changed in your favour. Go to Washington, DC this Tuesday, Spt. 18th and express your support to IV. Meet your lawmaker and ask what he/she can do for you.

We just received the ASC notice for biometric notice. The date they provided is the same date where we have an appointment in Mexico US Consulate.
Any experience for re-scheduling the biometric appointment. We would like the appointment to be earlier.

I have applied for my extension of H1B at Vermont Center. my first three years on H1b expired on Sep 8th. The application was filed on July 20th and it is normal processing. I have my H1b and H4 receipts with me, but its not yet approved. I am planning to take B1 visa appointment for my mother. Shall i send my mother to B1 stamping with H1B receipt.
Does Chennai consulate will accept H1b receipt for Visitor Visa or Shall we wait for H1b Approval? thanks in Advance....

My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July.

Here is my scenario
H4 visa----oct-2007 to sept-2010
Entered US---oct--2008 on h4
Filed for h1---april 2009

Actually i had to start a project dated 12-oct'09 but unfortunately the project got cancelled.From then i have been looking for project but no luck.Currently i am in a dilemma regarding my status and course of action.I am thinking to change my status to H4 again by filing i-539.
The main problem is my employer did not run any payroll for me since oct-st(official kick off date afetr h1 COS approval) i did not have any project and when i ask him about that he says he can state that i will officially join the company in Jan 2010 and he will start running the payroll from jan 2010
My questions are
1. How safe is it to apply COS at this point
2. If in case he starts running my payroll from Jan and still i dont land in a project even after couple of months can i go head and change my status to h4 in march with the 2 paystubs (jan and feb which he is promising to run)
3.in worst case if the payroll is not run by him what would be the best course of action
I would appreciate your response

I moved to US in 1987 got a 2 year conditional residence green card sponsored by my step father. Once the 2 years were met the new forms were submitted but I believe were a couple of days late. At the time I was 19. I remember vaguely remember it but we took the paperwork into the office.
So I waited and waited at an address shared with 2 college roommates and no new green card came. I thought maybe it came and someone had mistakenly through it away. No notice was sent to my mother's house for me to leave.
Well I never really bothered with it till more recently. I didn't work I had ID so other than violating the fact I didn't "carry" my green card everywhere I went, I thought i was perfectly legal.
In 1993 my mother passed away(still married to stepfather).
So about six months ago I decided to file an I-90 for a new card because I wanted to travel out of the US. They sent me an appointment for biometrics. I went to that and figured it was a done deal. Then they sent me a card that expired in 1989, explaining that I had filed the wrong form and needed to file like the I-751. Also they let me know that they would keep the fees for the wrong filing(the least of my worries).
So I briefly looked over this I-751 and basically I think I have to prove that my mother was married to my stepfather for the required time. First I barely remember his name, have no idea where they were married. Just looking for some help on this situation. Not really sure what to do.
I have an appointment on Monday with an immigration attorney. They ran my alien number for me and no action of deportation has been started. So I guess that is a good sign.
I have been here almost 21 years now and I like it here I want to stay :P
I'm from England btw not that this is a big deal just thought I would mention it.
